The first New York scooter injury case has been filed in the Bronx. A man named Victor Medina is pursuing a claim against IMMOTOR, LLC, the manufacturer of the Immotor GO Electric Scooter he was riding at the time of his accident. The lawsuit, filed in the Southern District of New York, claims that IMMOTOR, LLC’s negligence, defective design, and failure to warn of the scooter’s substantial dangers caused the crash.
According to Medina, he was riding his Immotor GO Electric Scooter on a pleasant New York afternoon when, without warning, the scooter’s brakes suddenly engaged on their own. This braking malfunction launched Mr. Medina over the handlebars and onto the pavement. As a result of the accident, Medina was knocked unconscious, sustained a concussion, fractured his left hand, and suffered a dislocated jaw, as well as lacerations on his face, knee, and left shoulder.
With more electric scooters hitting the market, and scooter rental services growing in popularity, there is a good chance we will see a rise in scooter accidents, whether as the result of consumer negligence or product malfunctions.
