What Happened?
What happened on May 30, 2022, should have never happened to Nicole. Shortly after moving into her apartment in March 2021, she began dealing with a leaky ceiling. Despite repeatedly reporting the issue, building management failed to properly fix it - only painting and repainting the affected area. Over time, the leak worsened and developed into a mold problem.
After months of frustration and unresponsiveness from management, Nicole filed an HP (Housing Part) action in New York City to compel her landlord to make the necessary repairs. The court eventually issued a judgment requiring them to fix the leak in her bathroom. But just days later, on May 30, 2022, tragedy struck.
While leaning over her bathtub to clean a clogged drain, the ceiling suddenly collapsed on top of her, knocking her unconscious. When she regained consciousness, Nicole immediately notified the building superintendent, who sent a handyman to cleanup the debris. A few days later, she went to urgent care, where she was evaluated, treated, and released.
As a result of the collapse, Nicole sustained serious injuries to her head (TBI), neck, back, left shoulder/arm (rotator cuff tear), right knee, and left leg. She experienced constant pain - both dull and sharp - with weakness in those areas. Her back pain often radiated into her left leg, causing numbness, tingling, and burning sensations. On her worst days, the pain was debilitating. She also suffered from headaches, dizziness, nausea, insomnia, difficulty concentrating, and short-term memory loss.
When conservative treatment failed to relieve her symptoms, Nicole underwent pain management injections and left shoulder surgery. She was forced to give up the recreational activities she once enjoyed and has been unable to work due to her injuries.
