What Happened?
On February 10, 2022, Garrett was in the Brooklyn apartment he had lived in for more than 12 years. Prior to that day, he had repeatedly complained to the building owner about ceiling cracks and other deterioration in his home. The cracks had been there for years, but nothing was ever done to fix them. While Garrett was sitting on his couch putting on his shoes, the ceiling suddenly collapsed, striking him on the head and left shoulder. He was taken by ambulance to a nearby hospital where he was evaluated, treated, and released home.
As a result of the accident, Garrett suffered injuries to his head, neck, and left shoulder, including a rotator cuff tear. He experienced headaches, dizziness, and significant shoulder and neck pain. Although he was discharged the same day, he returned to the hospital on February 18, 2022, due to ongoing headaches. He continued to struggle with left shoulder pain that limited overhead movement, neck pain with muscle spasms, tightness that worsened with turning his head, tingling in the shoulder, and difficulty sleeping on his left side. When conservative treatment failed, Garrett ultimately underwent left shoulder surgery on February 28, 2023.
Garrett’s Brooklyn Ceiling Collapse Lawyer
One week after the accident, Garrett contacted The Case Handler team for legal help. The building had been purchased just four months before the collapse, and the new owner denied having any notice of the specific ceiling issue. Even though Garrett - and other tenants - had reported multiple problems in the building, the Defendant still argued they were unaware of the exact ceiling defect and should not be held responsible. Despite the disputed notice, our top Brooklyn ceiling collapse lawyer successfully secured a $165,000 settlement for Garrett.
