What Happened?
In July 2020, Brenda was driving northbound in the left lane of the Bronx River Parkway in White Plains, New York, when she saw two cars ahead of her suddenly braking to a stop. She quickly began slowing down when the large SUV behind her rear-ended her with such force that it pushed her into the car in front of her, causing a 4-car collision. Despite the front of her car also getting smashed in, her airbags did not deploy. Immediately after the crash, Brenda had significant pain in both her left knee and left shoulder. She was taken by ambulance to the emergency room at a nearby hospital, where she was evaluated, treated, and subsequently released with pain medication.
As a result of the accident, Brenda suffered injuries to her neck, left shoulder, back, and left knee. She experienced constant neck pain that radiated down her back and left side. Her back pain radiated down her left leg, and she would often sit down for relief. She also experienced sharp pain in her left shoulder with restrictions in her range of motion (ROM) and paresthesia in the left hand. Her left knee would buckle and lock, causing a throbbing pain, especially when climbing stairs and walking. Prolonged standing and even walking 1-2 blocks caused her legs to feel weak and fall asleep. When conservative treatment failed, Brenda underwent pain management injections, left knee surgery, left shoulder surgery, and ACDF (neck) surgery.

According to their statements, the 1st driver said another car cut him off, forcing him to brake hard to avoid an accident. While the 1st driver avoided hitting that car, that’s when the chain of rear-end accidents happened behind him. The 2nd driver, behind the 1st driver, claimed to have stopped in time but blamed Brenda, the 3rd driver, for rear-ending his car and pushing him into the 1st driver. Brenda was stopping when she was first hit from behind and pushed into the 2nd driver. Finally, the 4th driver, who was driving a large commercial SUV, claimed that he saw all of the cars rear-end each other BEFORE he hit Brenda, trying to minimize his liability.

To make matters worse, the driver in front of Brenda later said he was hit TWO times, which would imply that Brenda hit him first before she was hit. This supported the 4th driver’s version of events and placed the blame on Brenda.
The 4th driver’s insurance company refused to take responsibility and pulled out all the stops to try to prove that Brenda hit the car in front of her first. For years, we continued to fight and refused to back down.
