What Happened?
On April 13th, 2020, Rose was waiting for the elevator at her apartment building when she decided to take the stairs because the elevator was taking too long. As soon as she began descending the stairs, she slipped and fell backward, sliding down several stairs! It appeared that someone had recently mopped the floor but she couldn’t tell that the floor was wet because there were no caution signs or cones anywhere in sight. After falling, she smelled bleach and her clothes later changed colors so she knew what she had slipped on. Rose was taken by ambulance to a nearby emergency room where she was evaluated, treated, and released home.
Rose injured her right shoulder, neck, and lower back due to her slip-and-fall accident. The impact of her fall caused her right shoulder to dislocate. She suffered from continuous pain, mostly in the tailbone of her low back. The pain grew worse with sitting for long periods of time, bending, and turning. She also experienced difficulty with raising her right arm above shoulder level and lifting heavy objects. When minimally invasive pain management therapy was no longer helping, she underwent lumbar spine pain management injections and right shoulder surgery on September 25, 2020.
Thankfully, Rose contacted The Case Handler team four days post-accident. After going through such a terrible fall within her own apartment building, not only did the property refuse to take responsibility but they even tried to argue that the bleach cleaning agent is not what they use to clean the stairs with and even tried to use Rose’s social media account to question her credibility! With the help of our talented Bronx apartment injury lawyer at Pollack, Pollack, Isaac & DeCicco, LLP, Rose’s medical bills were paid and she received a $450,000.00 settlement from the Defendant’s insurance company!
