What Happened?
On September 3, 2016, Sam was riding his bicycle without a helmet. As he was riding south on Webster Avenue (with the right-of-way), Sam was struck by a car making a left turn at the intersection of East 194th Street in Bronx, New York. Sam fell off his bicycle and landed on the pavement; hitting the left side of his head on the floor. According to the accident report, the driver was at an unprotected green light waiting to turn left. The driver claimed to not have seen Sam when he turned. Sam was taken by ambulance to St. Barnabas Hospital for evaluation and had a CT scan performed on his head. He was discharged to go home the next day.
As a result of the accident, Sam received 12 stitches for the laceration he suffered on the left side of his eyebrow. The CT scan taken of Sam’s head revealed that he also had an intraparenchymal hemorrhage (bleeding within his brain) on the left side of his head. Due to his head trauma, Sam experienced headaches that required medication to help alleviate the pain. He also went to different head injury medical specialists for further evaluation and treatment of his condition.
Before this accident, Sam was involved in a previous bicycle accident. Thankfully, he was not injured in that first accident. Unfortunately, that wasn’t the case this time around. Sam listened to Adam Handler on the radio for years and called The Case Handler team soon after the incident. The Case Handler team ensured that Sam’s medical bills were paid and we handled all of the complex legal issues surrounding Sam’s case including the lack of the use of a helmet and his comparative negligence in causing the accident. With Adam Handler’s fabulous legal counsel, The Case Handler team helped Sam successfully win his case against the Defendant’s insurance company.
