- Michelle from Yonkers, NY
What Happened?
On November 5, 2018, Michelle was a front-seat passenger in a vehicle traveling in the Bronx. The car was driving underneath the 6 train station when an MTA bus attempted to merge into their lane and sideswiped the passenger side - right where Michelle was sitting - at the intersection of Westchester Avenue and Whitlock Avenue. When police arrived, the bus driver claimed Michelle’s vehicle was at fault for “not seeing him,” insisting they caused the crash.
Michelle didn’t feel severely injured at first, but as her symptoms worsened, she went to a nearby hospital, where she was evaluated and treated before being discharged the next day.
As a result of the sideswipe, Michelle suffered injuries to her head, neck, back, and right hip. After hitting her head on the headrest, she experienced persistent headaches and neck pain radiating down her right upper extremity, as well as lower back pain radiating into her right hip. Daily activities such as standing, walking, climbing stairs, and completing work tasks became difficult, and the pain made it hard for her to sleep. Thankfully, conservative treatment helped her improve without needing injections or surgery.
Michelle’s Bronx Bus Sideswipe Lawyer
Michelle heard about The Case Handler team on the radio and reached out just three days after the accident. Even though Michelle’s car had been traveling straight in its lane when the bus entered and struck them, the defendant insisted they were not at fault and claimed Michelle’s driver should have anticipated the bus. Despite these liability disputes, our experienced Bronx bus sideswipe lawyer proved that the MTA was responsible and secured a $50,000 settlement for Michelle.
