“You’ll have a very good law firm when you go with The Case Handler team.”
– John from Bronx, NY
$40,000.00 Settlement
On January 16th, 2020, John was walking across the intersection of East Gun Hill Road and Eastchester Road in the Bronx when a driver did not see John walking and struck him on his left side! He lost consciousness briefly and the next thing he remembered was waking up in the emergency room. John was taken by ambulance to Jacobi Medical Center where he had diagnostic testing performed and was given pain medication before being discharged. The driver of the vehicle reported to the police that John did not have the pedestrian signal to cross the street and blamed him for the accident.
As a result of the pedestrian accident, John sustained injuries to his right shoulder, lower back, and left leg. He described the worst area of pain to be in his right shoulder which was a constant aching sensation. X-rays and MRIs confirmed that he suffered internal bleeding in his stomach and a collarbone fracture. Additionally, he stated that his lower back pain felt like a constant sharp sensation that radiates down his lower extremity causing paresthesia (a “pins-and-needles” sensation) in his left leg. John explained that his pain was aggravated by prolonged activities and in sleeping positions. He would wake up feeling stiffness in the morning and it made it very difficult for him to get up.
As a long time listener of our legal talk show on 93.5 FM and Facebook, John knew exactly who he wanted to handle his personal injury case. The driver and his insurance company blamed John for causing the accident since he was not using a designated crosswalk to cross the street. The insurance company initially offered only $12,500! It’s a lot of money for most people, but nowhere near to what we believe John deserved. Their next low-ball offer was $15,000, and we responded with a lawsuit! Thanks to our diligent Bronx Pedestrian collision lawyer at Pollack, Pollack, Isaac & DeCicco, LLP, we helped John recover $40,000.00 to settle his bodily injury claim!
Have you ever crossed the street where it was not a crosswalk? If you live in New York City, our bet is that most of you have. While it’s a very common thing in NYC, it doesn’t mean you should do it. According to NYC DOT, pedestrians are 10 times more likely to die than a motor vehicle occupant in the event of a collision. As pedestrians, we expect drivers to take extra caution since our lives are basically in their hands. If you or someone you know were injured by a vehicle while walking like John was, we encourage you to “go with The Case Handler team.”
