What Happened?
On May 6, 2023, Janice was riding as a front-seat passenger in a vehicle traveling through the intersection of Van Sinderen Avenue and Blake Avenue in Brooklyn, NY. The car she was in had the right of way, but another car failed to stop at the stop sign and struck her vehicle. After the crash, the other driver initially apologized to Janice but later told the police that they had stopped at the stop sign and were struck by Janice’s vehicle. Janice was taken to a nearby hospital, where she was evaluated, treated, and released home with pain medication.
As a result of the collision, Janice suffered injuries to her left shoulder and neck. She experienced persistent neck pain radiating into her shoulder, along with intermittent tingling and numbness. The pain limited her ability to raise her left arm and perform everyday tasks such as dressing herself. While physical therapy provided temporary relief, Janice continued to struggle with overhead activities. When conservative treatment failed, she underwent pain management injections and eventually required left shoulder surgery (partial rotator cuff tear) in June 2024.
Janice’s Brooklyn Injured Passenger Lawyer
A week after the accident, Janice contacted our office thanks to a friend’s recommendation. In New York, injured passengers may be entitled to recover compensation from both the insurance of the vehicle they were riding in and the other driver’s insurance.
In Janice’s case, the insurance company for the car she was in claimed the other driver was fully at fault and refused responsibility, while the other driver’s insurer argued that Janice’s vehicle caused the crash. Despite these disputes, our skilled Brooklyn injured passenger lawyer proved Janice’s right to recover compensation from both parties.
We successfully secured $150,000 from the defendant’s insurance, plus an additional $20,000 from the host vehicle’s insurance - bringing Janie’s total settlement to $170,000.
