-Sydney Sinclaire from Brooklyn, NY
$39,500.00 Settlement
On May 10, 2017, Sydney was heading home from work and holding onto groceries with her right hand. As she was walking across the street at the intersection of Avenue D and Bank Street in Brooklyn, New York, a vehicle turning left struck the left side of Sydney’s body in the middle of the marked crosswalk! When the vehicle struck Sydney, she felt her right-hand thumb (that was holding groceries) get pulled. While lying on the ground after the accident, she felt immediate pain in her hand and all over her body. Sydney was taken by ambulance to Brookdale Hospital Medical Center where she underwent routine examinations and released for outpatient care.
As a result of the accident, Sydney injured her neck, lower back, left shoulder (tear), left knee, left hip and right hand/thumb. The pain in her neck radiated to the left shoulder with numbness and tingling in her hands/fingers. Sydney described the pain in her neck as a sharp deep pain with a pressure around the neck. The pain in her lower back radiated to her left leg and she also felt numbness/tingling in her feet. Her leg pain worsened with standing and walking. Daily life for Sydney after the accident changed significantly. She experienced fatigue, difficulty sleeping, concentrating and performing activities of daily living. Sydney went to therapy for several months, and later underwent injections to her lumbar spine, left shoulder, and left knee.
A past client of ours and good friend to Sydney told her to call The Case Handler team after she heard about Sydney’s accident. Thankfully, she did! While Sydney focused on recovering from the accident, our team jumped into action for Sydney’s bodily injury claim. After thorough research, our team was determined to win $40k for Sydney. The insurance company initially offered $15k, and then $15,500 next. We weren’t even halfway to our goal and the insurance company refused to budge! We knew Sydney deserved more than what the insurance company was offering so we filed a lawsuit. After the lawsuit was filed, the insurance company started to (magically) increase their offer to $20,000, $21,500, and $23,000. It was at that point that The Case Handler team successfully won Summary Judgement, which is like a slam dunk! A full trial would not be necessary since we provided all the necessary proof to prove the defendant’s liability for the accident. After winning Summary Judgement, the insurance company offered $25,000 and then $30,000. Finally, the insurance company offered a fair $39,500.00 settlement award in the range we wanted for Sydney and accepted for her!
Sydney’s case is a great example that you can only get so far on your own without a real professional. It doesn’t even matter when insurance companies are working with a team of experienced legal professionals like our team. If the insurance companies make it painfully difficult for our team, imagine how difficult it is trying to negotiate with big insurance companies all by yourself. Don’t accept any offer from the insurance company without first speaking with a reputable Brooklyn pedestrian accident attorney that will not settle for just any offer or take the easy way out in your case. If you or a loved one were injured in a pedestrian accident, call the team that will “will look out for your best interest.”
