What Happened?
On August 18th, 2022, Edison was driving eastbound on Church Avenue in Brooklyn, New York when an aggressive driver from behind was speeding past Edison. Apparently, the other driver was speeding to get away from the police! The driver was passing too closely and sideswiped the left side of Edison’s car and drove off! Edison was taken by ambulance to the emergency room of Kings County Hospital Center where he underwent multiple radiological studies, was treated, and discharged home.
Edison injured his neck, back, right shoulder, left thigh, and both knees due to the accident. Unfortunately, he had a previous injury that required surgery nearly 30 years ago to his left thigh (femur fracture). As a result, his left lower extremity pain was aggravated after this accident. He attended weeks of physical therapy sessions and participated in a home exercise program. Thankfully, he was not required to undergo surgery.
Thanks to a friend’s recommendation, Edison spoke with our team the day after his accident. Although the other driver left the accident scene, we were still able to locate the vehicle and its insurance company based on the license plate. Upon further investigation, we discovered the vehicle was a rental and the insurance on the car denied liability because the driver “failed to comply with the conditions of the rental agreement.” Edison was prepared for a situation just like this because he had Uninsured Motorist (UM) coverage to protect him! Although it was his own insurance company, they offered him a shockingly low settlement. With the help of our Brooklyn sideswipe crash lawyer at Pollack, Pollack, Isaac & DeCicco, Edison recovered nearly 3.2 times more than his insurance company’s initial offer within 5 months!
