What Happened?
On October 1st, 2021, Lynell was waiting for the walk signal at the intersection of East 52nd Street and Foster Avenue in Brooklyn, New York. She waited for a couple of vehicles to pass through the intersection and proceeded to cross the street when she saw no other vehicles around. Lynell was near the middle of the crosswalk when she was suddenly struck from behind by a car! She landed on the hood of the car and then fell down to the ground. She was taken by ambulance to the emergency room at Brookdale University Hospital where she was evaluated, treated, and discharged home.
Lynell injured her lower back as a result of the accident. Since she landed on her lower back/tailbone when she was hit, Lynell experienced intermittent lower back pain that worsened with sitting, driving, and normal activities of daily living. She also occasionally felt left-sided low back pain that would extend into her left hip. She was unable to work for a few days. While she eventually was able to go back to work with light duties, Lynell still had difficulty working due to her back pain. Physical therapy and her home exercise program have been helpful in her recovery.
After the accident, a friend of Lynell immediately told her to call The Case Handler team! So the same day she was hit by the car, she also contacted us for legal assistance. While Lynell got the treatment she needed to focus on healing, our team went to work to build her case and handle her bodily injury claim. According to the Defendant’s insurance, Lynell did not have severe injuries, which resulted in them slapping Lynell across the face (figuratively speaking of course) with a ridiculously low settlement offer that we refused to accept. With the help of our unstoppable Brooklyn pedestrian accident lawyers at Pollack, Pollack, Isaac & DeCicco, LLP, Lynell’s medical bills were paid, she recovered her lost wages, and she won a settlement that was 2.5x more than the Defendant’s original offer!
