What Happened?
In March 2025, Fabiola was walking home and crossing a marked crosswalk at the intersection of Beach 20th Street and Plainview Avenue in Queens, New York. While she was crossing, a van struck her on the left side of her body, causing her to fall. The driver remained at the scene and called 911. When the police arrived, the driver claimed to have made a full stop at the intersection before proceeding to make a left turn when Fabiola suddenly appeared in front of the vehicle. The driver claimed to have stopped when they saw Fabiola and was “unsure if the vehicle hit” her. Fabiola was transported by ambulance to the hospital, where she was treated, evaluated, and released home early the next morning.
As a result of the accident, Fabiola suffered injuries to her left shoulder (rotator cuff tear), neck, and left knee (medial meniscal tear). As a left-handed person, the injury was more detrimental to her daily life. She experienced constant, shooting pain that worsened with increased activity, lifting, and movement. She had difficulty lifting heavy objects and staying asleep due to the pain. She participated in conservative treatment for several months and was unable to work for a few months as well.
