What Happened?
On January 4th, 2017, Krystal was riding the Long Island Railroad (LIRR). The train was arriving at the Atlantic Terminal in Brooklyn when it derailed and hit the wall! Krystal was standing up when the collision occurred and was thrown forward as a result of the derailment. She did not lose consciousness, thankfully, but she did experience an immediate headache, and pain to her left knee and right shoulder. Her left leg was splinted and she was taken by ambulance to the emergency room at Kings County Hospital.
As a result of the accident, Krystal injured her head, hands/wrists, knees, hips, right shoulder, neck and back. She felt numbness and paresthesias (“pins and needles” sensation) in her hands and down her leg. She also experienced balancing issues which made it very difficult for her to move about. She suffered from multiple disc herniations in her lower back (lumbar spine) and neck (cervical spine) that later required her to undergo surgery to remove the herniated discs in the neck, which is referred to as an anterior cervical discectomy and fusion (ACDF) surgery on January 18, 2018. Krystal was totally incapacitated from employment since the accident.
Although Krystal did not know what to do after the accident, her loving husband remembered the top Long Island Railroad accident attorneys in NYC to call: Adam Handler – The Case Handler! Several years before this train accident, Krystal actually had a previous injury to her left knee, arms, and hands after falling in front of a department store. Even though many years had passed since her fall, the defendants can and did use her prior accident against Krystal to diminish her injuries from the train accident. While other lawyers would shy away from going up against huge defendants like the MTA and LIRR for someone that had a previous injury, our personal injury team at Pollack, Pollack, Isaac & DeCicco, LLP did not back down and recovered a $3,000,000.00 settlement for Krystal!
