What Happened?
On December 12, 2016, a vehicle was driving northbound on Ocean Avenue in Jersey City, New Jersey. The vehicle then made a left turn onto Bartholdi Avenue at the exact moment Jesus was walking across the street. The vehicle struck Jesus and he was thrown to the ground! The driver of the vehicle told the police that Jesus walked out in front of his car and caused the pedestrian accident. Due to his injuries, Jesus was unable to provide information to the police. Jesus was taken by ambulance to Jersey City Medical Center where he was treated and later transferred to Kessler Rehabilitation Center for inpatient rehabilitation.
As a result of the accident, Jesus sustained a traumatic brain injury, dysphagia (difficulty swallowing), respiratory insufficiency, hypertension, deep vein thrombosis (DVT), cognitive dysfunction and gait dysfunction. Jesus hit his head when he was struck by the car and experienced significant combativeness and confusion at the scene of the accident. The initial CAT scan of his brain showed a left parietal cephalohematoma (collection of blood that’s like a bruise). Jesus also suffered right facial abrasions, multiple hemorrhages, and a skull fracture. To this day, Jesus has been disabled and is unable to perform his usual functions.
Thanks to his friend’s recommendation, Jesus got the phone number of The Case Handler team! Allegedly, Jesus was not walking on the crosswalk when he was struck by the vehicle according to the Defendant. Therefore, the insurance company argued that Jesus shared some blame in the accident and should recover less money as a result. This legal defense is known as comparative negligence. Insurance companies will use everything they can to diminish the amount of damages a plaintiff can recover. With the hard work of our devoted New Jersey pedestrian accident attorneys at PPID, The Case Handler team proved the defendant’s negligence and we built a strong defense for Jesus to recover the highest compensation possible. In the end, we successfully helped Jesus recover $325,000.00!
