What Happened?
On September 9, 2020, Kendra was driving early in the morning on Queens Boulevard in the right lane on a service road. As she approached the 63rd Road intersection, a garbage truck in the left lane suddenly made a right turn without signaling, colliding with the driver’s side of Kendra’s vehicle. Upon impact, Kendra recalled hitting her head against the window. Subsequently, the garbage truck driver informed the police Kendra had “suddenly sped up,” causing the collision. Kendra was then transported by ambulance to the hospital, where she underwent evaluation, treatment, and was discharged later that day.
The auto accident resulted in injuries to her left shoulder and neck. Kendra experienced persistent neck pain, accompanied by a tingling sensation radiating to her left upper extremity. Her pain intensified with various activities such as bending, twisting, lifting, and even routine movements like ambulation. Consequently, she faced difficulties performing household chores and sleeping. Despite undergoing minimally invasive pain management procedures, her left shoulder pain persisted, leading her to undergo left shoulder surgery, including a repair of a SLAP tear, labral tear, and rotator cuff tear, under general anesthesia. While Kendra reported an overall improvement of 60% following the surgery, she still occasionally experienced pain and weakness during overhead activities. Furthermore, her injuries rendered her unable to work for an extended period.
Following the accident, Kendra promptly sought legal representation, turning to The Case Handler team on the same day of the incident. Despite the garbage truck driver’s attempt to shift blame onto Kendra for speeding, our team obtained video footage corroborating that the truck driver failed to exercise due caution while making the turn. With the assistance of our highly-rated Queens garbage truck accident lawyer, Kendra successfully recovered her lost wages, had all her medical expenses covered, and secured a settlement of $200,000.00!!
