$100,000.00 Settlement
On October 24th, 2021, Lexi was a front seat passenger in a vehicle that was being driven by her husband in Queens, New York. As they went through the intersection of Hillside Avenue and 243rd Street, another vehicle entered the intersection and struck the back passenger side of their car. The impact of the collision caused the vehicle Lexi was riding in to spin out of control with airbag deployment! The other driver told the police that his view was blocked by other traffic which is why he didn’t see Lexi and her husband’s car. Upon investigation at the accident scene, the police discovered that the driver that hit Lexi had a suspended license with a total of 3 suspensions! The driver was arrested on scene. Lexi was taken by ambulance to Long Island Jewish Emergency Department where she was evaluated, treated, and subsequently released.
As a result of the car accident, Lexi suffered injuries to her neck, mid back, lower back, and significantly injured her right shoulder. When the side airbags deployed during the collision, it hit her right shoulder very hard. She experienced post-traumatic headaches and anxiety as well. The pain she felt in these areas was constant and made it difficult to sit, bend, turn her neck, look up or down and perform her tasks at work. She also had difficulty falling asleep and finding a comfortable position to rest. Lexi attended physical therapy and later underwent right shoulder surgery (rotator cuff repair) on January 26, 2022.
Thanks to a friend’s recommendation, Lexi called The Case Handler team two days after the accident! Upon learning that the other driver had a suspended license, it was no surprise that the driver also had NO auto insurance. Thankfully, Lexi was prepared for this exact situation and had Uninsured Motorist (UM) coverage through their own insurance provider that gave protection in the event that they were hit by another driver with low or no insurance. With the help of our excellent Queens no insurance accident lawyer at Pollack, Pollack, Isaac & DeCicco, LLP, all of her medical bills were paid and she recovered the MAXIMUM POLICY LIMITS from the insurance company!
How much Uninsured/Underinsured Motorist (UIM/UM) coverage do you have? All drivers in New York are required to carry $25,000 in uninsured and underinsured coverage per person (up to $50,000 per accident. Our team was able to recover the maximum $100k coverage Lexi had which would have been a very different outcome if she had the minimum amount. Look at your insurance policy and make sure you have enough if, God forbid, you ever get into an accident with someone that has no insurance like Lexi did. If you’ve been injured by an uninsured or underinsured driver, we can help build your case and make the insurance company more likely to pay.
