What Happened?
On November 3rd, 2021, Sally was heading to work on Hillside Avenue in the left lane when a truck traveling on 208th Street made a left turn on Hillside Avenue and crashed into the driver’s rear side of Sally’s vehicle. The impact was so strong that it pushed her vehicle into the right lane and her bumper fell off! Later that day, Sally went to an urgent care facility, where she was evaluated, treated, and discharged home less than 24 hours later with prescriptions for pain medications.
Sally injured her lower back, left shoulder (rotator cuff tear), and right ankle (multiple ligament tears) due to this accident. She complained of constant low back pain radiating to the right lower extremity that was associated with a cramp-like sensation on the right leg. Bending over would exacerbate her back pain, overhead activities would exacerbate her left shoulder pain, and prolonged standing or walking would exacerbate her right ankle. Sally experienced headaches for several days after the accident. She underwent months of therapy and was required to undergo right ankle surgery under general anesthesia on January 21st, 2022. She was unable to work for several months and was totally disabled for approximately 22 weeks.
As a loyal listener of our show on 93.5 FM radio, Sally already knew just which lawyer to call! The same day her accident took place, she called The Case Handler team. Our team filed a motion for summary judgment (to help expedite a case by asking the court for a judgment on the merits of the case when there are no disputes about the facts of the accident). While the truck driver apologized to Sally after the accident, his facts about the accident were not the same and our motion was denied! We filed an appeal and as it was pending, our resilient Queens Village truck accident lawyer at Pollack, Pollack, Isaac & DeCicco, LLP successfully paid all of Sally’s medical bills, recovered her lost wages, and won her a $300,000.00 settlement from the Defendant’s insurance company!
