What Happened?
On February 10, 2018, David was working as a driver at night. While driving on Park Lane South, he slowed down to a stop behind another vehicle when the traffic light turned red at the intersection of Myrtle Avenue. While waiting for the light to turn green, David was rear-ended by another vehicle and pushed into the rear of the car in front of him. He went to Long Island Jewish Hospital a few days later where he was treated and later released.
As a result of the work-related motor vehicle accident, David suffered injuries to his neck, upper back, and right shoulder. He felt excruciating neck pain with right arm numbness and tingling. The pain in his right arm/shoulder made it difficult to lift his arm and carry things. He was required to do physical therapy for several weeks to help reduce his pain and improve overall function. David also received an injection into his right shoulder, which “helped with the pain a little.” When conservative treatment failed to relieve David’s pain, he underwent surgery to his right shoulder to repair his labral tear, partial rotator cuff tear, and bursitis.
